Substance Abuse Evaluation
It is preferable for the provider performing the evaluation and assessment not provide services to avoid the problem of self dealing in recommended unneeded treatment. Because of this built in incentive, there have been abuses by Utah agencies in recommending treatment to courts. Courts routinely encourage Defendant’s to come into court if they disagree with the recommendations.
ARS, or Assessment Referral Services, is associated with the University of Utah School of Medicine. It is generally considered the most fair, impartial and accurate evaluation agency in Utah, because it does not provide its own treatment. It should be noted that ARS charges a significantly higher fee for people living outside of Salt Lake County.
Birchcreek Psychotherapy Associates is a private company who performs evaluations and assessment and does not provide services themselves, thus avoiding the issue of self dealing.
ARS substance abuse evaluations (they don’t perform domestic violence evaluations or mental health evaluations alone).

Domestic Violence Evaluation
When a person pleads no contest or guilty to a domestic violence, a typical condition of the plea in abeyance or probation is to submit to a domestic violence evaluation and assessment and complete recommended treatment.

Anger Management Evaluation
In non-domestic violence assault cases, or in some domestic violence cases that are minor or isolated, a judge may order a defendant to complete an anger management assessment and class. Typically, the anger management classes are level 1, 2 or 3. Level 1 is a 6 hour class. Level 2 is a 6 week class and Level 3 is a 12 week course.

Mental Health Evaluation
A Defendant may be suffering from an undiagnosed or untreated or mistreated mental health condition. In these situations, defense attorneys frequently have their clients submit to a mental health evaluation to determine if there are any underlying mental health conditions/needs that should be addressed at the time of sentencing.

DUI and MIP Evaluation
When a person pleads guilty to a DUI or a Minor In Possession (MIP), courts uniformly order the defendant to submit to a DUI/MIP evaluation and assessment and complete recommended treatment. The entry level treatment is called Prime for Life.

Ankle Monitor, Scram, Home Confinement
There are a number of situations in which a court may require a defendant to submit to home confinement in lieu of jail time, and/or constant alcohol monitoring. A SCRAM ankle monitor constantly tests the subject’s skin secretions for alcohol and alcohol metabolite. A GPS monitor, which can be part of the SCRAM monitor or independent of it, is used to verify the person’s whereabouts for home confinement purposes.
