Utah Expungement Petitions and Eligibility

First things first. In order to obtain a Utah expungement, the Bureau of Criminal Identification has to approve a certificate of eligibility. Typically, eligibility is determined based on your criminal record and the time that has lapsed since your arrest, conviction, incarceration, probation, or parole. For example, if you were arrested but not charged, you are eligible to have your record expunged after 30 days have passed. If you were convicted of a misdemeanor, the waiting time is three, four, or five years, depending on the class of misdemeanor. If you have a felony record, you typically have to wait seven years. Convictions for certain types of crimes – such as those requiring registering as a sex offender or violent felonies – are never eligible for expungements in Utah.

The Nuances of Utah Expungements
